By using the services of TML Remittance Center Sdn Bhd (“TML”), you agree to the following terms and conditions, which govern all international money transfer transactions conducted through TML, its branches, agents, correspondents, or partner institutions.
1. Scope of Services
TML provides international money transfer services to customers (“Sender”) for the purpose of remitting funds to a designated beneficiary (“Recipient”) in another country. Services are subject to the laws and regulations of Malaysia and the receiving jurisdiction, as well as the policies and compliance requirements of TML.
2. Liability Limitation
2.1 The liability of TML shall be strictly limited to the amount actually received from the Sender or paid out by TML to the Recipient, whichever is applicable, for a particular transaction.
2.2 TML shall not be liable for:
- Any consequential, indirect, or incidental damages (including lost profits, lost opportunities, or emotional distress).
- Any delay, underpayment, misdelivery, or non-delivery of funds due to system errors, technical failures, force majeure events, or regulatory restrictions.
- Errors caused by the Sender, the Recipient, foreign agents, intermediaries, or other third parties.
2.3 In no event shall TML’s liability exceed the original principal amount of the money transfer.
3. Right to Refuse Transactions
TML reserves the right to refuse, suspend, or cancel any money transfer transaction at its sole discretion, including but not limited to the following situations:
- Failure of the Sender or Recipient to provide proper and valid identification.
- Suspicion or confirmation that the transaction is linked to money laundering, terrorism financing, fraud, scams, or any illegal activity.
- Transactions in violation of applicable laws, regulations, or TML’s compliance policies.
TML shall not be liable for any losses or damages arising from refusal of a transaction.
4. Unpaid Transactions
4.1 Any remittance not claimed by the Recipient within three (3) weeks from the date of transfer shall be returned to the originating foreign agent or Sender, less applicable charges.
4.2 If payment was not made due to:
- Recipient’s failure to collect,
- Incorrect, incomplete, or misleading information provided by the Sender,
the service fee/commission will not be refunded.
4.3 Where the failure was due to an error attributable to TML, the Sender may be eligible for a full refund, subject to investigation.
5. Exchange Rates & Charges
- All transactions are subject to applicable exchange rates and service charges determined by TML at the time of transaction.
- Exchange rates may fluctuate and TML does not guarantee the availability of any rate until the transaction is confirmed.
- Additional charges imposed by correspondent banks, agents, or intermediary financial institutions shall be borne by the customer.
6. Customer Responsibilities
By using TML’s services, the Sender and Recipient agree to:
- Provide true, accurate, and complete information required for the transaction.
- Produce valid and acceptable identification documents as requested.
- Ensure that the funds sent are from lawful sources and not linked to any criminal, fraudulent, or prohibited activity.
- Indemnify and hold harmless TML against any claims, damages, or losses arising from false or misleading information provided.
7. Data Protection & Privacy
TML respects customer confidentiality and will only use personal information in accordance with applicable data protection laws. However, TML may disclose information to:
- Regulatory authorities, law enforcement, or courts when legally required.
- Correspondent banks, agents, or payment processors for the purpose of completing the transaction.
- Fraud prevention and compliance monitoring systems.
8. Fraud & Scam Awareness
TML shall not be liable for losses suffered due to the Sender being a victim of fraud, scam, or deception (e.g., lottery scams, romance scams, fake job offers). It is the customer’s responsibility to verify the legitimacy of the Recipient.
TML reserves the right to block or investigate transactions suspected to be linked to fraudulent activity.
9. Force Majeure
TML shall not be liable for any delay, interruption, or failure to perform obligations due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, network failures, system outages, government restrictions, or war.
10. Refunds & Cancellations
- Refund requests must be submitted in writing and are subject to TML’s internal review and approval.
- Service charges are non-refundable unless the error was due to TML.
- Refunds may take up to 30 working days depending on the involvement of correspondent banks and agents.
11. Dispute Resolution
Any disputes arising from TML’s services shall first be addressed through internal complaint channels. Customers may escalate unresolved complaints to Bank Negara Malaysia (BNM) or the relevant regulatory authority.
12. Amendments
TML reserves the right to amend, modify, or update these Terms & Conditions at any time without prior notice. The latest version shall always apply to all transactions.
